Subject: Legislative decree/act n° 196/2003 art. 13

                The undersigned, in observance of art. 13 of  the legislative decree/act n° 196 -30 June 2003, “code regarding confidentiality of personal data” wishes to inform you on the processing of the data obtained directly from you, either verbally or through third parties which is defined as “confidential information”. The undersigned points out methods and diffusion of the “confidential information” as well as the nature and underwriting of the same.

Purpose of processing/agreement

With regards to the observation of legal, fiscal, contractual and accounting obligations, in order to consent to an efficient management of business relationships.

Method of agreement/processing

“The sensibile data “ will be dealt with, in written form and /or magnetic support, electronic or wire in full respect of minimum security measures regarding the above stated decree/act  n° 196/03 attachment B, Technical  Regulations.

Nature of conferment “Confidential information/personal data”

Confidential information/personal data must be released .

Absence of conferment regarding confidential information/personal data

Eventual refusal of conferment of personal data may determine the impossibility to begin any contractual relationships .

Subjects to whom data could be released to:
According to communications and releases completed by law, your “data” in accordance to the goals of the agreement, could be devulged to the following:

  1. Company personnel in charge of your business agreement
  2. Our agents/representatives
  3. Credit Institutes and/or Banks
  4. Credit Bureaus (collection & investigations)
  5. Consultants and Professionals
  6. Transport Companies

Any further communications  regarding your personal data will be released only upon your consensus .

Legal rights in art. 7 (legal rights to access confidential information/personal data and other)
Concerning your data, the legislative decree/act n° 196/03, art. 7 of the following transcript , can be apllied all legal rights within the limits and the conditions in articles 8,9,10 of the same decree/act.

  1. The party interested , has all rights in obtaining confirmation of the existence or not of confidential information/personal data, regarding him/them and their communication in any comprehensible form even though not yet registered.
  2. The party interested has  the legal right to obtain explanations:
    1. Of the origin of the confidential information/personal data
    2. Reason for and method of the processing /agreement
    3. The purpose of use of auxiliary electronic support
    4. All information regarding identification of owner,managers and /or directors, and representatives of the company; art. 5 comma 2
    5. Subjects and groups of categories to which the “data” could be communicated to, as designated representatives, on the national territory…, managers, directors and /or subjects in charge of the company.
  3. The party interested has  the legal right to obtain:
    1.  Updating, corrections, integrations of all data when of interest.
    2. The cancellation and transformation in anonymous form for the block of the data in violation of the law , including those of which are not necessary to store. The reason why the data was collected or eventually devulged, must be stipulated.
    3. To attest that points a) and b) have been communicated also in regards to their content to those who have received the data except in the case where the observance of the above stated decree/act is impossible.
  4. The party interested has the legal right to oppose any use of the data, in part or all :
    1. For legitimate reasons regarding the processing of confidential information/personal data being appertinent to the purpose for the collection of the confidential data
    2. To the processing of confidential data regarding the above with the objective to send advertising material  or for direct sales or for market research or commercial communications
